McCurry widow files suit in Cocke County crash
The widow of a North Carolina man who was killed in a multi-vehicle crash in Cocke County last year, has filed a lawsuit in Cocke County Circuit Court. Sheila McCurry is the widow of Ricky Lee McCurry, who was killed in a crash on I-40 near the 443 mile marker on September 16, 2013. The lawsuit says the crash occurred before sunrise as McCurry drove his rig westbound. According to the action, Roger Shane Hawk, Tobacco Way, Hartford, was operating a Hartford Towing rollback wrecker, pulling a flatbed trailer with 200 wooden pallets when "pallets fell off their truck and/or the flatbed utility trailer onto the roadway." The action also says a car driven by Andrew Paul Scott, of North Carolina collided with the rear of the utility trailer causing numerous pallets to fall off and be strewn across the westbound lanes of the interstate. McCurry came suddenly upon the "chaotic scene in the darkness and was confronted with pallets and obstructions in the roadway. He collided with the flatbed utility trailer as pallets came crashing through his windshield," the lawsuit says. The action alleges that Scott and his employer, Worldwide Information Systems, along with Hawk and Hartford Towing, were negligent and violated a number of Tennessee traffic statutes, leading to the death of McCurry. A long-time Cosby Volunteer firefighter,Elmer Clayton Ball, 33, Roy Road, Cosby, who was a passenger in the wrecker, also died when he was struck by an unidentified object as he walked along the roadway after the initial crash. The lawsuit asks for $10 million in compensatory damages and $10 million in punitive damages from Scott, Hawk and their employers.
