Overholt charges thrown out
Charges against a Cocke County restaurateur have been thrown out in Greene County. Eddie Bruce Overholt, 76, of Briar Thicket,was arrested July 18 when he asked participants at a meeting of the Greene County Industrial Development Board to speak up. He along with other attendees were at the meeting to oppose a move to build a pipeline from the Nolichucky River to the proposed U.S. Nitrogen ammonium nitrate plant, to obtain water and a parallel line to dump discharges from the plant back into the waterway. Many area residents are concerned that the discharges will pollute the river, however company officials dispute that charge. Participants at the meeting were speaking quietly, and the audience was unable to hear the discussion. After Overholt asked the participants to speak louder he was escorted from the room and charged with disrupting a public meeting and resisting arrest. The charges were dropped Friday at the request of District Attorney General Berkley Bell. Following the meeting, nearly 60 complaints were filed with the Tennessee Office of Open Records Counsel alleging a violation of state law by the participants. Oversite attorney Elisha Hodge then informed Greene County Mayor Alan Broyles who chaired the meeting, that state law mandates that government bodies meet in a way that permits the public to hear the issues being deliberated and /or the decisions being made. Later the Tennessee Department of Transportation approved a right-of-way for the lines, however that decision is being appealed because current state regulations allow only for utility districts to provide water and sewer services
