Suit filed to stop U.S. Nitrogen piping plan
As expected, Old Knoxville Highway Utility District has gone into Greene County Chancery Court, challenging the plans by U.S. Nitrogen to operate it's own pipeline for water and sewer. The firm is in the process of building a plant and wants to get it's water from the Nolichucky River and also pipe it's discharges to the pristine waterway. The Tennessee Department of Transportation has approved a plan to put the eight miles of piping along highways, but with the provision that the pipe be available to any firm who wants to use it. But the utility points out that the plans would illegally compete with it's service, pointing to state law which provides a utility is the sole provider for water and sewer unless alternative services would serve the public convenience and necessity. In this case U.S. Nitrogen plans the double pipe as a cost saving move. The utility says it is prepared to serve the company with water and sewer services. The firm says it wants to control the water supply which will require pre-treatment before it is used and again before it is discharged. Community members have opposed proposals by the firm to control it's own water supply and discharges, saying they are concerned that the discharges would not be adequately treated, and result in pollution of the waterway. Defendants in the lawsuit are the Greene County Industrial Development Board which has been promoting the piping plan, U.S. Nitrogen and Greene County.
