Litigation filed in 2013 church bus crash
Several victims of the Oct. 2, 2013 church bus crash on Interstate 40 in Jefferson County have filed a lawsuit against the manufacturer of the tire that investigators say blew out, causing the crash that claimed the lives of eight, and injury to an additional six. A total of six members of Front Street Baptist Church in Statesville, North Carolina were among the victims. The lawsuit was filed last week in Iredell County Superior Court in North Carolina, and names as plaintiffs the 12 survivors on the bus, and the estate executors of five of those killed in the wreck, all of whom were members of the church. It alleges that Hankook Tire Co., the maker of the front left tire that blew out and caused the bus to veer out of control, “knew or should have known…that the subject tire’s design and/or manufacture resulted in a defective product which exposed vehicle occupants and other motorists to unreasonable danger when the product was put to it reasonably foreseeable use.” The estate of Randy Morrison, who was driving the bus at the time, and was killed in the accident, also is named as a defendant. Investigators had earlier said they believe the tire may have hit a foreign object as it drove causing the tire to be weakened, and leading to the blow-out. But attorneys for the plaintiffs argue the crash was caused by a defective tire. The crash occurred as members of the church were returning to Statesville on a church sponsored trip to a religious gathering in Gatlinburg. The bus crossed the median and struck a tractor trailer rig and a SUV. One occupant in each of the other two vehicles also died but their estates are not plaintiffs in the lawsuit. Investigators filed no criminal charges because the cause was determined to be a tire failure. Each of the 17 plaintiffs is seeking damages that “exceed $10,000,” along with punitive damages to be determined by the court.
