Transgender lawsuit
Tennessee is one of 11 states that Wednesday filed a federal lawsuit against the Obama administration's recent guidance to public schools on which bathrooms transgender students may use. The states argue the U.S. Department of Justice and U.S. Department of Education are taking away local control and trying to create a national social experiment by telling districts to allow transgender students to use the bathroom corresponding to the gender with which they identify. "Defendants have conspired to turn workplaces and educational settings across the country into laboratories for a massive social experiment, flouting the democratic process, and running roughshod over commonsense policies protecting children and basic privacy rights," the lawsuit argues. Tennessee Attorney General Herbert Slatery is listed as the official suing on behalf of Tennessee. "Our Office has consistently opposed efforts like this to take away states’ rights and exclude the people’s representatives from making these decisions, or at a minimum being able to engage in a notice and comment period under the Administrative Procedures Act," Slatery said.
