Cocke Circuit Court sentencing
A Cocke County jail inmate who escaped the facility on August 2, on Monday entered a guilty plea to an escape charge. decided Wednesday morning to go for a swim in the Pigeon River, was arrested a short time later. Kenneth Rathbone, 56, Grand View Way, Cosby, was assigned to the jail kitchen as a trustee and as inmates were unloading a delivery truck, Rathbone ran from the facility. The inmate changed into civilian clothing and at some point entered the Pigeon River evading authorities who were searching the area. A short time later a witness reported seeing Rathbone on Cope Boulevard, approximately 1.5 miles from the jail, and he was taken into custody after being tased on White Oak Avenue. Rathbone was serving a two year sentence for Failure to Appear, Driving while Revoked, Aggravated Assault, Leaving the Scene of an Accident, Failure to Exercise Due Care, and Reckless Endangerment. He pleaded guilty to a felony jail escape charge and Circuit Court Judge Carter Moore ordered Rathbone to serve an additional year in jail. At the time of the escape, Cocke County Sheriff Armando Fontes said, "this is yet another example of an inadequate jail facility which is in need of a secure loading dock and a secure perimeter to prevent the escape of inmates. I am very thankful that no one was injured in the incident." Also on Monday Lisa Barnett, 38, no address given, pleaded guilty to four counts of TennCare Fraud involving the sale and delivery of prescription medications. Asst. DA. Tonya Thornton told Judge Moore that Barnett obtained numerous prescriptions in May and June from various providers. The defendant was given a two year term, released on time served and the balance of the sentence will be served on probation. The sentence will be served concurrently with a Hamblen County case stemming from similar charges. Judge Moore also ordered Barnett to make restitution of $3,233, but she will not lose her TennCare eligibility. Judge Moore also issued a capias for several defendants who didn't show for their court hearing. Those ordered held without bond are; Jason Dwain Kimbel, James K. Moore, Jennifer Lee Suddath, Joshua Stout, Kenneth O'Dell and Wendy Williams.
