Bush Brothers fined The Tennessee Occupational Safety and Health Administration(TOSHA) has imposed a fine on Bush Brothers, in connection with death at it's Chestnut Hill plant earlier this year. On April 23, Shannon Smith, 40 of Dandridge was pulled into a machine at 3 am and died at the scene. Several weeks earlier another employee was injured at the plant in a work-related accident and was flown to the UT Medical Center in Knoxville Following an investigation, TOSHA found three key issues in the Smith death, and imposed a $8,175 fine. Investigators found the employee didn't use a correct procedure while cleaning and the company didn't use proper guarding, which would keep employees from being pulled into the equipment. They said both violations were directly responsible for the death. The investigation also found that the facility failed to deliver hazard communication training to insure the equipment was locked, to prevent operation during cleaning. TOSHA said that violation was not directly involved in Smith's death. Company officials told investigators that Smith was cleaning a pallet de-stacker when she climbed into an area under a scissor lift platform. The machine was left in automatic mode instead of manual mode which would have kept the machine from operating on its own. The victim apparently activated an electric eye that put the scissor lift into motion, pulled her in and killed her.
