Gardner denied new trial
Judge James Gass on Thursday denied a new trial for a man convicted in February of aggravated sexual battery of a child, in Cocke County Circuit Court. The court gave Donald Gardner, 43, Millville, New Jersey a 12 year sentence and ordered that it be served at 100 percent. Judge Gass also ordered the defendant to register as a violent sex offender and to be under community supervision for life. Gardner was staying at a home on Myers Circle in Newport when he sexually assaulted the seven year-old female as she took a bath in August 2016. In denying a new trial, the court held there was clear evidence of the issues, which were more than sufficient to justify the guilty verdict. Judge Gass ruled that there was no basis for a new trial.
