Abortion stay is denied
The Sixth Circuit Court of Appeals has denied a request to keep Tennessee's 48-hour waiting period for abortions in effect while it hears an appeal of a lower court's ruling that found it unconstitutional. A Nashville judge ruled in October that Tennessee’s waiting period serves no legitimate purpose while placing a substantial burden on women who want abortions in Tennessee. Representatives of Tennessee abortion clinics said during trial that the requirements created challenges that caused abortions to be delayed beyond the 48 hours required by law. The delay pushed some women beyond the time when they could have medication abortions. Tennessee had asked the Court of Appeals to stay Friedman's ruling until the appeal is resolved, but the appellate judges held that, the law poses an undue burden on women seeking abortion. It concluded that the state was unlikely to succeed in its appeal and so was not entitled to have the ruling put on hold. Judge Karen Nelson Moore wrote that the Tennessee law “appears to be yet another unnecessary, unjustified, and unduly burdensome state law that stands between women and their right to an abortion.”
