Jessica L. case The Tennessee Court of Appeals has declined to hear the appeal of a mother who had her parental rights terminated by Cocke County Juvenile Judge Brad Davidson in December, 2016. The order terminating the parental rights of Jessica L., to the minor child, Braxton L., was entered on December 29, 2016. The Notice of Appeal was not filed until February 2, 2017, more than thirty days from the date of entry of the final order. State law says a notice of appeal in a civil case must be filed within, and received by, the clerk of the trial court within 30 days after the date of the judgment. Assistant Attorney General Rachel E. Buckley, on behalf of the Tennessee Department of Children’s Services, filed a motion to dismiss the appeal based on the late filing. "Because the Notice of Appeal was not timely filed, we have no jurisdiction to consider this appeal and grant the motion to dismiss", the appeals court ruled on Wednesday.
