US Supreme Court gets Tennessee abortion law appeal
Opponents of a 2014 ballot measure that stripped the right to an abortion from the Tennessee Constitution have appealed its outcome to the U.S. Supreme Court. Amendment 1, approved by 53 percent of voters, added language to the state's constitution that says: "Nothing in this Constitution secures or protects a right to abortion." Its passage allowed Tennessee lawmakers to enact stricter abortion regulations, including a 48-hour waiting period for women seeking an abortion. The campaign for and against the ballot measure was one of the most hotly contested and expensive ballot fights in Tennessee history. Within days of the vote, eight voters who opposed the measure sought a recount. A federal appeals court rejected those efforts in January. The appeal to the Supreme Court, filed last week, continues the challenge to the state's method of counting votes for the ballot measure as well as the legal tactics of attorneys in the office of the Tennessee attorney general. The appeal asks the high court to consider two questions: whether election officials conducted the election in a biased manner, and whether state attorneys acted lawfully in filing their own suit against the eight plaintiffs in the case. Unlike a simple majority required for candidates, the Tennessee constitution requires ballot measure to succeed with a "majority of all the citizens of the state voting for governor, voting in their favor." State attorneys and election officials contend that ballot measures must receive a majority of the number of votes cast for governor to succeed.
